Whiplashed carer claims against Employers liability insurance

You have to be a certain sort of person to work in industries which care for members of the community. Doctors, health workers, nurses and carers all have incredibly important jobs to do and ordinary citizens rely on their knowledge and assistance in times of illness or old age.
Acknowledging the vital services these people provide, the public and patients would expect that employers within the care industry would want to make the day-to-day jobs of their employees as easy as possible so they can provide the highest levels of patient care and the implementation of employers liability insurance was simply a protective measure.
However it has recently been reported that a care home assistant has sustained whiplash-like injuries whilst assisting a resident out of the bath. The unnamed individual was manually operating a assistance bath seat, a device designed for assisting the less mobile in and out the bath, when the seat caught on a broken bath panel causing it to snap back suddenly.
The carer sustained injuries which were originally diagnosed as a pull muscle but has subsequently been off work for 12 weeks after being award £4000 compensation after her claim against her employers liability insurance.
It has been suspected by risk management experts that the carers employers failed to carry out an adequate risk assessment which would have identified the potential injuries which could have been caused by both the broken bath panel and the old bath assistant chair.
