Employer's liability insurance has been called upon in any number of cases. Recently a courier service, Tuffnells Parcels Express Ltd based in Sheffield has evoked the use of its employer's liability insurance after an employee fractured his thigh bone whilst at the company's depot in Sheffield.

Michael Tierney suffered the accident in March 2008 and the court heard that the employee had been loading up the firms smaller lorry carriers at the loading bays, when the driver of the vehicle pulled away unexpectedly. Tierney then fell roughly four feet sustaining the injury to his thigh bone.

Tuffnells Parcels Express Ltd was fined over £5,000 for breaching the Health and Safety at Work Act 1974. An inspector form the Health and Safety Executive said that as a company which have over 600 vehicles and over 25 depots across the UK they should have proper and appropriate loading and unloading codes of practices.

Further still each new driver to the firm should be given the appropriate training needed for loading and unloading practices and a risk assessment should accompany any new employee's contract. On this occasion the driver had not received ay training, a risk assessment or even a contract.
