Liability insurance scope tested by strip club
Posted on July 05th 2010
A test case in the claims against BP in the US will ask one of the questions everyone wants to hear the answer to about the extent of liability: how far removed can you be from a disaster before being able to put in a liability insurance claim?
No-one would argue that people whose property and livelihood have been directly affected by the Gulf of Mexico disaster cannot make a claim. But a test case that's likely to come to court involves a strip club in New Orleans.
They argue that they should be able to put in a liability claim as fishermen can no longer afford to come to the club, leading to a detrimental effect on their trade. Whether the lawyers allow the case to be bought will be of interest to liability insurance customers everywhere.
