Injured by rice and beans

Employer's liability insurance has been used in all kinds of different claims. Recently KTC Edibles appeared in court in relation to an accident where a worker fell down at hole in the workplace.
KTC had to call upon their employer's liability insurance when the court issued fines stretching over £15,000 as recompense for ignoring a Prohibition notice which was issued by an environmental health and safety officer from the Health and Safety Executive back in February 2008.
Noshad Ali lay trapped and injured underneath a mezzanine floor which had collapsed from underneath him. Ali was then ensnared between 1,000kg bags of rice and beans which had they fallen over posed a considerable threat to the worker's survival.
The actual incident itself involving Ali, who broke his leg at the Wednesbury premises owned by KTC Edibles, was not discovered until another incident caused officials to investigate the occurrence further. KTC Edibles' failure to report the injury cast a shadow over the company's overall character in the court.
It would appear that a health and safety environmental officer gave the company instruction on how to avoid an accident by erecting a barrier around the area to prevent people falling in. However KTC failed to follow the advice given to them which lead the Ali's accident.
