Environmental liability changes finally come to England

Two years after the EU directive's deadline for implementing the environmental liability law the Environmental Damage Regulation finally came into force on the 1st March.
As a result many businesses are unaware of their liabilities under the new legislation, which state that any entity carrying out economic activity can be held liable for remedying any environmental damage that has been caused by their activity.
Those caught breaking the new law may not be covered under a standard public liability insurance policy as it does not cover the costs involved in clean up operations and preventative measure to ensure it doesn't happen again.
Insurance to cover this new liability is not mandatory, just like public liability insurance, as the emphasis is on the natural development of existing liability policies to cope.
