Employers liability insurance excuses broken chair?

We all know the irritations caused by an uncomfortable seat, endlessly shifting around to get comfortable but never quite finding the perfect position and as common sense dictates, you wouldn't sit on a chair if it was broken because you could end up on the floor.
However Southend-on-Sea Borough Council didn't seem to follow this common strain of thought when Kay Fagg, a Council employee, was made to use a broken chair in the office. Subsequently, their employers liability insurance has unnecessarily been called into action.
Unfortunately for Fagg the broken chair gave way causing her un-surprisingly to fall to the ground and she consequently slipped a disk in her vertebrae. Fagg had to under go surgery, where she nearly died, to correct the injury and has been forced to retire due to the constant lower back pain caused to her.
Rubbing salt into the wounds, the Borough Council only replaced her chair after she had returned to work after her operation and it has taken a full year for a risk assessment and all corrective equipment to be installed.
Fagg, as some consolation, has been awarded £10,000 in compensation for her injury.
