Abattoir avoids employers liability claim

Potentially several injuries have been avoided by the Environment Agency after they served an enforcement notice to the West Scottish Lamb abattoir in Carlisle. Jointly, they have also saved the West Scottish Lamb from several serious employers liability claims although business has had to be suspended in the interim.
The noxious smells were detected from the abattoir and several complaints by both staff and residents were lodged against the company. The enforcement notice has suspended work in the site until something has been done to eliminate the polluting smells.
However experts noted that these nasty smells also posed a considerable risk to staff as it proved a nasty distraction to workers using heavy and dangerous machinery, which should require total focus. If a worker had sustained an injury whilst on site the abattoir would face hefty employers liability insurance claims.
Moreover, before the source of the smells had been discovered as effluent discharge, the gases released could have also contained toxic elements that should have been drawn away from workers using the appropriate extraction units.
The Environmental Agency revealed that it had already prosecuted the owner of the abattoir, Chitty Food Group, for breaching trade effluent limits and failure for measuring discharge in previous sites.
