Agency workers not classed as employees
The court of appeal case of James v London borough of Greenwich has ruled that agency workers are not employees of the business and therefore do not have the same rights as those who are employed directly by the business regardless of time of service as there is no direct contract of employment.
The decision will come as a relief to many businesses that rely on agency staff. This decision will also have an impact on a large number of employment tribunal cases that were suspended until the outcome of this case was resolved.
